In order to establish the International Maritime Justice Center, serve the construction of the Belt and Road, deepen the fine maritime trial quality strategy, and improve the trial efficiency and quality of maritime cases involving foreign, Hong Kong, Macao and Taiwan attributes, Ningbo Maritime Court has confirmed the establishment of the Trail Guide of Maritime Case involving foreign, Hong Kong, Macao and Taiwan Attributes as one of the important jobs in this year. Recently, through the specific conference of maritime judges and trial committee, Ningbo Maritime Court issued this Trail Guide, which means that the first handbook about maritime cases involving foreign, Hong Kong, Macao and Taiwan attributes has come into service.
The guide has the following features: First, the content has wide coverage. The main body is divided into 4 parts, which are registration, service abroad, case trial and judgment document. Each part is also subdivided into third-grade or fourth-grade items according to the categories, almost covering all aspects of maritime cases involving foreign, Hong Kong, Macao and Taiwan attributes. Second, according to the demand of trials of maritime cases, by absorbing the latest laws, judicial interpretations and guidelines issued by Zhejiang High People¡¯s Court and our court, the operability and timeliness of this guide are quite strong. For example, in the registration process, The Advice of the Supreme People¡¯s Court on strengthening the service work in civil cases (fafa(2017)No.19) has been referred to. When dealing with pre-trial evidence preservation involving foreign attributes and pre-arbitration maritime preservation, the according guidelines issued by our court in 2016 have been referred to.
This guide clearly stipulates the process of service abroad and lists the names and contact information of the commissioners of our court and the high court. With regards to finding out the foreign laws, the relevant experience published in the Journal of Court Research NO.292 has been referred to. In respect of the writing standards of legal documents, it is in accordance with The Notice of the Supreme People's Court on Issuing the Rules For the Writing Standards of the Civil Trial Documents of the People's Courts and the Style of Civil Trial Documents, The Notice of the Supreme People's Court on Issuing the Rules For the Writing Standards of The Maritime Trial Documents Involving Foreign Attributes, and the relevant format requirements made by the high court. Third, the annex catalogue contains 35 documents, including the relevant international conventions, laws, judicial interpretations and other administrative rules. Corresponding to the specific items contained in the four main parts, it facilitates the quick access to the information required by the judge in trial. In the next stage, we will compile and print it for the judges.
